Jesica Cirio asked the Justice Department not to use as evidence against her and her ex-husband Martín Insaurralde the videos published by the newspaper LA NACION, where she is seen surrounded by bundles of dollars in a large dressing room. Both are being investigated for alleged illicit enrichment and money laundering. Cirio argued before federal judge Luis Armella, temporarily in charge of the federal court of Lomas de Zamora, that an expert report determined that it could not be established that the videos were traceable or that they had not been manipulated. Cirio's lawyers, Claudio Caffarello and Nicolás Urrutia, stated that the videos "neither deserve nor justify, in a process that prides itself on quality regarding evidence, to be part of the universe of incriminating evidence, which is expressly requested." The defense's argument is based on the conclusions of the expert report conducted by DATIP, the technical area of the Public Prosecutor's Office, on the images published on June 20. According to the defense, the expert opinion raises doubts about the authenticity of the material. The first question concerns the metadata: the experts found that the internal timestamps of each file's capture were "completely zero," indicating that the videos were resent via a messaging service or subjected to some editing, transcoding, or transfer process by applications like WhatsApp, Telegram, or Signal, which remove source data. For the lawyers, this prevents asserting that it is a reliable document. The report emphasizes that none of the seven videos came with a hash code prior to their extraction in DATIP, the digital fingerprint that guarantees a file has not been altered. They argue that this code was only calculated during the expert processing, nearly two months after the material was entered into the case file. They stated that its traceability cannot be established. The experts noted that the internal record described a USB drive in the evidence envelope, but inside was actually a Kingston 32 GB micro SD card within its adapter. This discrepancy, the defense affirms, "affects the authenticity and traceability of the submitted elements." With these arguments, Caffarello and Urrutia conclude that, lacking the original file system, it cannot be determined the origin, production context, or the identity of the person who generated the images, and they requested that the material be excluded from the universe of incriminating evidence. The decision on the validity of the evidence now rests with the judge of Lomas de Zamora.
