Tolosa Paz reported to the federal Justice the misuse of funds for the roads and asked to investigate the Government

National Deputy Victoria Tolosa Paz filed a criminal complaint today for alleged embezzlement of public funds and other crimes before the Federal Justice to investigate how the Casa Rosada manages the resources of the so-called Integrated Road System (SisVial), after the government itself admitted that it uses part of the funds legally allocated to national roads to "achieve fiscal balance." Tolosa Paz requested that the Justice assess whether libertarian officials committed embezzlement of public funds, fraudulent management to the detriment of Public Administration, breach of public official duties, and incompatible negotiations with the exercise of public office in the management of 1.038 trillion pesos of SisVial that have not been allocated to the construction and maintenance of national roads and road works. According to the data cited in the legislator's complaint from Unión por la Patria (UP), SisVial collected 1.503 trillion pesos over two and a half years but only allocated 394.406 million pesos to its specific purpose, representing an under-execution of 73.8%. In 2024, 11.3% of the allocated resources were executed; in 2025, 39%; and between January and May 2026, just 18.5%. As of last May 31, according to LA NACION, 1.001 trillion pesos were invested in financial instruments such as fixed-term deposits and public bonds, while another 37.761 million pesos remained in a checking account. The complaint also states that not all the allocated revenue may have effectively entered the trust, and requests to determine how much money reached SisVial, how much remained invested, and what was the destination of the resources that were potentially withheld before entering their accounts. The judicial complaint is particularly relevant because the presidential spokesperson, Adrián Ravier, acknowledged that part of the taxes that feed the system are allocated by the Ministry of Economy to achieve fiscal balance, although he could not specify what proportion is effectively destined for road maintenance. The complaint seeks to determine whether this use is compatible with the specific allocation of resources and which official or agency issued the corresponding instructions. Tolosa Paz argued that these are resources that the national state collects with a specific and irrevocable legal purpose. "What we are reporting is that tax resources with a specific and irrevocable destination — the payment for works and maintenance of the national road network — were withheld and massively invested in financial instruments," she said. One of the main examples analyzed concerns the works on national routes 3 and 5 in Buenos Aires province, partially financed through CAF loan 11744. The program includes work on RN5 between Mercedes and the Suipacha Bypass and on RN3 between San Miguel del Monte and the Gorchs access. "The situation of national routes 3 and 5 is a concrete example of this contradiction. There are contracted works, international financing, and available SisVial resources, but the local counterpart has not been executed as committed. Argentina takes on debt to finance the works while the national funds allocated to those same works remain invested in financial instruments," she noted. The financing scheme establishes a 30% contribution from the local counterpart and 70% external financing. However, according to audit reports for 2024 cited in the complaint, the execution of the local counterpart was 0%, despite the availability of SisVial resources. The levels of progress were also cited as evidence of delay. The work on RN5 between Mercedes and the Suipacha Bypass had a physical progress of 16.89% and a financial progress of 11.36% as of May 2026. Another section of the same route, between the RP 41 distributor and kilometer 104, had a physical progress of just 0.88% as of December 2025, although the contract was supposed to end in October of that year. On RN3, between San Miguel del Monte and the Gorchs access, physical progress reached 26.95% as of May 2026. Previous Complaints The actions of the Casa Rosada regarding road works have accumulated complaints and reports since at least February 2025, when the Buenos Aires Minister of Infrastructure, Gabriel Katopodis, appeared with several provincial mayors before the Federal Administrative Litigation Court No. 1 of San Martín to explain the destination of fuel tax revenue. "Every time you refuel at a service station, one-third of that goes to a specific account that, by law, is solely for road repairs, which are in a total state of neglect," he explained. Additionally, the Federation of National Road Personnel (FePeViNa) publicly denounced the "discretionary and illegitimate" use of SisVial revenue. "3,000 km of roads could have been rehabilitated. 22,000 km more could have been maintained," they estimated. "The numbers are conclusive: resources exist, political will does not." Meanwhile, Alejandro "Topo" Rodríguez, former national deputy and director of the Federal Consensus Institute, demanded that the Casa Rosada account for itself because "it decisively breaches the law, drastically reducing transfers to provinces, transportation subsidies, and capital expenses." In this regard, Tolosa Paz asked the judiciary yesterday to order urgent measures to preserve documentation related to the management of funds since January 2024. Among these, she requested to preserve instructions issued by responsible officials, administrative files, emails, accounting and banking records, and to certify the current balances of SisVial accounts and their investments.
